No obstant aix\u00f2, la mat\u00e8ria est\u00e0 regulada per l<strong>a jurisprud\u00e8ncia sobre la instal\u00b7laci\u00f3 d&#8217;ascensors en una comunitat de propietaris<\/strong>, establint les l\u00ednies a seguir davant l&#8217;abs\u00e8ncia d&#8217;un consens.<\/p>\n<p>Les decisions judicials pr\u00e8vies al conflicte o els criteris tinguts en compte pels jutges per dictaminar les seves sent\u00e8ncies en sup\u00f2sits relatius determinen els precedents que guien la presa de decisions, ajustant-se a dret en el marc de les lleis ja existents. La mateixa afavoreix la instal\u00b7laci\u00f3 dels dispositius de mobilitat vertical <strong>quan sigui en benefici de millorar l&#8217;accessibilitat i eliminar les barreres arquitect\u00f2niques<\/strong> que limiten que persones amb mobilitat redu\u00efda es puguin despla\u00e7ar amb facilitat.<\/p>\n<p>Per procedir amb la instal\u00b7laci\u00f3 d&#8217;un ascensor, \u00e9s necessari obtenir l&#8217;aprovaci\u00f3 a la junta de ve\u00efns mitjan\u00e7ant majoria simple, \u00e9s a dir, que el &#8220;s\u00ed&#8221; representi la majoria de les quotes de participaci\u00f3.<\/p>\n<p>No obstant aix\u00f2, hi ha <strong> excepcions a aquesta regla<\/strong>: si el sol\u00b7licitant \u00e9s un propietari el domicili del qual o local \u00e9s habitat o utilitzat per persones amb <strong>discapacitat o majors de 70 anys<\/strong>, n&#8217;hi haur\u00e0 prou amb aquesta \u00fanica sol\u00b7licitud. \u00c9s important destacar que aquest \u00faltim sup\u00f2sit nom\u00e9s ser\u00e0 viable si l&#8217;import de la derrama repercutit anualment a tots els ve\u00efns no excedeix de dotze mensualitats ordin\u00e0ries de despeses comunes, despr\u00e9s d&#8217;haver-se descomptat les subvencions i ajudes p\u00fabliques.
