Tanmateix, els baixos d\u2019una comunitat segueixen els mateixos criteris o s\u00f3n diferents per tractar-se d\u2019habitatges? <\/p>\n<p>Els baixos s\u00f3n, per definici\u00f3, els habitatges situats a nivell de carrer i, habitualment, no requereixen l\u2019\u00fas dels ascensors per accedir a la propietat. Aquesta circumst\u00e0ncia ha portat molts propietaris a plantejar-se si realment estan obligats a assumir els costos associats al manteniment, reparaci\u00f3 o modernitzaci\u00f3 dels ascensors, una despesa que, en la majoria de comunitats, representa una part important del pressupost anual. <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-52d67cc elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"52d67cc\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-436bd1d\" data-id=\"436bd1d\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-6f3d934 elementor-widget elementor-widget-heading\" data-id=\"6f3d934\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Ascende: Your Strategic Elevator Partner<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d2628e5 elementor-widget elementor-widget-text-editor\" data-id=\"d2628e5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Prenent com a base la <strong>Llei 49\/1960<\/strong>, de 21 de juliol, sobre Propietat Horitzontal (LPH), en el seu article 9, tots els propietaris han de contribuir a les despeses comunes en funci\u00f3 de la seva quota de participaci\u00f3. Ara b\u00e9, tot i que aquesta obligaci\u00f3 \u00e9s la norma general, existeixen certes excepcions que poden aplicar-se en situacions concretes. Aix\u00ed doncs, no \u00e9s una regla autom\u00e0tica ni f\u00e0cil d\u2019assolir: cal complir condicions espec\u00edfiques i, en molts casos, comptar amb l\u2019aprovaci\u00f3 de la comunitat i que aquesta excepci\u00f3 estigui recollida expressament als estatuts.  <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-28e70cb elementor-widget elementor-widget-heading\" data-id=\"28e70cb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Factors que determinen si els propietaris de baixos paguen el manteniment de l\u2019ascensor<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2e60911 elementor-widget elementor-widget-heading\" data-id=\"2e60911\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Estatuts espec\u00edfics que eximeixen expressament els baixos del pagament<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c89830b elementor-widget elementor-widget-text-editor\" data-id=\"c89830b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"MsoNormal\" style=\"line-height: 150%;\"><span style=\"font-family: 'Open Sans Ligth',sans-serif; mso-bidi-font-family: Arial; mso-ansi-language: ES;\">Un dels factors que pot determinar si els baixos han de pagar el manteniment de l\u2019ascensor \u00e9s l\u2019exist\u00e8ncia de <b>cl\u00e0usules espec\u00edfiques <\/b> en els estatuts de la comunitat. Si en aquests consta expressament que els propietaris d\u2019habitatges en planta baixa queden exempts de l\u2019obligaci\u00f3 de contribuir a les despeses de manteniment, llavors no estaran legalment obligats a assumir aquests costos.  <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%;\"><b>En els casos on aquesta cl\u00e0usula no existeixi,<\/b> <span style=\"font-family: 'Open Sans Ligth',sans-serif; mso-bidi-font-family: Arial; mso-ansi-language: ES;\">s\u2019ent\u00e9n que tota la comunitat t\u00e9 el deure legal de pagar la seva quota.<\/span><\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0a86597 elementor-widget elementor-widget-heading\" data-id=\"0a86597\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Acord aprovat<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2d9c6f5 elementor-widget elementor-widget-text-editor\" data-id=\"2d9c6f5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Per modificar, reduir o eximir els propietaris dels baixos de l\u2019obligaci\u00f3 de contribuir al manteniment de l\u2019ascensor, la comunitat pot aprovar un <strong>acord espec\u00edfic en la junta de propietaris. <\/strong> <\/p>\n<p>Perqu\u00e8 aquest acord sigui v\u00e0lid, cal complir amb les majories legals que estableix la Llei de Propietat Horitzontal. En el cas del manteniment de l\u2019ascensor, en tractar-se d\u2019un assumpte ordinari, es requereix el <strong>vot favorable de la majoria dels propietaris<\/strong> que, alhora, representin la majoria de les quotes de participaci\u00f3 presents o representades a la junta. <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9a25025 elementor-widget elementor-widget-heading\" data-id=\"9a25025\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Habitatge sense acc\u00e9s com\u00fa a l\u2019ascensor<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7be7cd1 elementor-widget elementor-widget-text-editor\" data-id=\"7be7cd1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>En aquells casos en qu\u00e8 l\u2019habitatge en planta baixa no tingui acc\u00e9s a l\u2019ascensor ni comparteixi zones comunes relacionades amb aquest servei, els propietaris poden q\u00fcestionar si els baixos han de pagar el manteniment de l\u2019ascensor quan no en reben cap benefici directe.<\/p>\n<p>Aquesta circumst\u00e0ncia pot ser un <strong> argument v\u00e0lid per sol\u00b7licitar l\u2019exempci\u00f3 del pagament,<\/strong> sempre que es pugui demostrar que l\u2019ascensor no forma part de les \u00e0rees comunes a les quals el propietari accedeix o utilitza.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a8e668e elementor-widget elementor-widget-heading\" data-id=\"a8e668e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Instal\u00b7laci\u00f3 posterior de l\u2019ascensor<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a36c343 elementor-widget elementor-widget-text-editor\" data-id=\"a36c343\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>La jurisprud\u00e8ncia estableix que, quan un ascensor s\u2019instal\u00b7la despr\u00e9s de constru\u00efdes les vivendes, els propietaris dels baixos que no van participar en la instal\u00b7laci\u00f3 poden tenir dret a no pagar-ne el manteniment. Aix\u00f2 es deu al fet que no es beneficien directament ni van consentir aquesta despesa, per la qual cosa poden sol\u00b7licitar l\u2019exempci\u00f3 o una reducci\u00f3 proporcional. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5b7c026 elementor-widget elementor-widget-heading\" data-id=\"5b7c026\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Reducci\u00f3 o ajust del coeficient de participaci\u00f3<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-940817d elementor-widget elementor-widget-text-editor\" data-id=\"940817d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"MsoNormal\" style=\"line-height: 150%;\"><span style=\"font-family: 'Open Sans Ligth',sans-serif; mso-bidi-font-family: Arial; mso-ansi-language: ES;\">Un altre factor que pot influir en si els baixos han de pagar el manteniment de l\u2019ascensor \u00e9s la possibilitat d\u2019ajustar el coeficient de participaci\u00f3 que tenen assignat en la comunitat.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%;\"><span style=\"font-family: 'Open Sans Ligth',sans-serif; mso-bidi-font-family: Arial; mso-ansi-language: ES;\">Sempre que existeixi acord entre els propietaris, es pot <b>establir una quota redu\u00efda<\/b> per als residents de planta baixa, equivalent a l\u2019\u00fas real que en fan del servei.<\/span><\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5e3b50a elementor-widget elementor-widget-heading\" data-id=\"5e3b50a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Nul\u00b7litat de cl\u00e0usules abusives<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0e94f72 elementor-widget elementor-widget-text-editor\" data-id=\"0e94f72\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Quan s\u2019imposa als propietaris dels baixos l\u2019obligaci\u00f3 de pagar el manteniment de l\u2019ascensor sense un acord previ, sense consens en junta ni una justificaci\u00f3 clara en els estatuts, es pot considerar una cl\u00e0usula abusiva. En aquests casos, els afectats poden acudir als tribunals per sol\u00b7licitar la nul\u00b7litat d\u2019aquesta obligaci\u00f3. <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-49ceff5 elementor-widget elementor-widget-heading\" data-id=\"49ceff5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Quan es pot ajustar o renegociar la contribuci\u00f3 que els baixos paguen en manteniment d\u2019ascensor?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d91696b elementor-widget elementor-widget-text-editor\" data-id=\"d91696b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Hi ha diversos <strong>escenaris pr\u00e0ctics<\/strong> en qu\u00e8 \u00e9s possible ajustar o renegociar la contribuci\u00f3 que els baixos paguen pel manteniment de l\u2019ascensor. Els propietaris poden presentar una proposta en la junta de ve\u00efns, i perqu\u00e8 sigui v\u00e0lida, ha de ser aprovada per majoria qualificada, tal com estableix la Llei de Propietat Horitzontal. Si la modificaci\u00f3 s\u2019aprova, \u00e9s imprescindible inscriure-la al Registre de la Propietat, de manera que tingui efectes legals tamb\u00e9 per a tercers i futurs propietaris.  <\/span><\/li>\n<li><b style=\"font-style: inherit; text-align: justify; text-indent: -18pt;\"><span lang=\"es\" style=\"font-family: 'Open Sans Ligth',sans-serif; mso-bidi-font-family: Arial;\">Acord espec\u00edfic d\u2019una quota diferenciada:<\/span><\/b><span lang=\"es\" style=\"font-family: 'Open Sans Ligth',sans-serif; mso-bidi-font-family: Arial;\"> Una altra alternativa per reduir el que els baixos paguen pel manteniment de l\u2019ascensor \u00e9s establir una quota diferenciada per a aquests propietaris. Aquest acord ha de ser aprovat en una junta de propietaris i recollit per escrit en l\u2019acta corresponent, assegurant aix\u00ed la seva validesa i aplicaci\u00f3 futura.
